2. Description of Service

DoNotStay is a browser extension that uses artificial intelligence to analyze publicly available hotel reviews from booking platforms and generates algorithmic opinions in the form of summarized verdicts, confidence scores, and red flags. All verdicts and analysis represent automated opinions based on pattern analysis of third-party guest reviews. They are not statements of fact, professional recommendations, or guarantees of hotel quality. The Service is provided "as is" and is intended for informational purposes only. DoNotStay does not verify the authenticity or accuracy of individual guest reviews. The Service includes publicly accessible hotel verdict pages on our website that display cached analysis results generated by extension users.

3. User Accounts

Some features of the Service may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Resell, redistribute, or sublicense the Service without authorization
  • Use automated systems to access the Service in a manner that exceeds reasonable use

5. Intellectual Property

The Service and its original content, features, and functionality are owned by DoNotStay and are protected by international copyright, trademark, and other intellectual property laws.

6. AI-Generated Content

All analysis, verdicts, confidence scores, red flags, and summaries generated by the Service are the output of automated AI algorithms. They represent an algorithmic opinion based on publicly available guest review data at a specific point in time. Hotel conditions change frequently, and AI analysis may contain errors or misinterpretations. Users should not rely solely on DoNotStay verdicts when making booking decisions. DoNotStay is not a substitute for reading actual hotel reviews.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or completeness of any AI-generated analysis or verdict. Hotel conditions may change, and reviews may not reflect current circumstances.

8. Limitation of Liability

DoNotStay shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to decisions made based on AI-generated verdicts. Without limitation, DoNotStay shall not be liable for any losses arising from booking decisions made in reliance on AI-generated verdicts, including but not limited to costs of alternative accommodation, travel disruptions, or dissatisfaction with hotel quality. Users acknowledge that hotel conditions may differ from the AI analysis at the time of their stay.

9. Third-Party Services

The Service analyzes publicly available data from third-party websites (such as Booking.com). DoNotStay is not affiliated with, endorsed by, or connected to any booking platform. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

10. Credit Packs and Payments

Credit pack purchases are one-time payments. Credits do not expire. All purchases are non-refundable except as required by applicable law. Prices are subject to change. Price changes apply to new purchases only and do not affect existing credits.

11. Dispute Process for Hotel Owners

Hotel owners or managers who believe a verdict is inaccurate may submit a dispute to disputes@donotstay.app. DoNotStay will review all disputes in good faith and may update or remove verdicts where appropriate. Submission of a dispute does not guarantee modification of any verdict. Verdicts are generated algorithmically from publicly available guest reviews and reflect patterns in that data.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
